Our Policies

ESSENTIAL INFORMATION, SAFETY GUIDELINES & BOOKING POLICIES

Payments & Bookings

To guarantee your spot in our small-group experiences, we apply the following payment policy:

 

  • Initial Booking: A deposit of 50% of the total price is required at the time of booking to block the date and secure your space on board.

  • Remaining Balance: To ensure the logistics for your trip, the remaining 50% must be settled within the following timeframes:

    • Local Tours and Scuba Courses: The balance must be paid at least 48 hours before departure.

    • Full-Day Expeditions: The balance must be paid at least 72 hours before departure.

Note: For last-minute bookings made within these windows, 100% payment is required upon confirmation.

  • Multi-day Bookings & Cash Payments: A 50% deposit is required for all activities. Cash payments are only available for guests booking multiple days; in these cases, the balance for your first day must be settled online via the payment link. For subsequent activities, you may pay the balance in cash on your first day, provided this occurs before the 48h or 72h deadline for those specific tours. Otherwise, the balance must be cleared online to keep the reservations active.

  • Payment Methods & Currency: All online payments are processed in Mexican Pesos (MXN). Please be aware that if your bank account is located outside of Mexico, your financial institution may apply its own foreign exchange rates or international transaction fees. These charges are independent of our service, and we recommend checking with your bank for their specific policies on international payments.

  • Exchange Rate: We use a fixed exchange rate of 18 MXN per 1 USD.

​

  • Refund Management: For cancellations that qualify for a refund according to our Cancellation by the Client policy, a 10% fee of the total amount paid will be retained for non-recoverable administrative and banking fees.

​

  • Pricing Transparency: To be fair to all our guests, we maintain a policy of fixed and final pricing. At Breathe Out Baja, we prioritize quality over volume: our rates reflect the true cost of operating small groups with high-end equipment and expert staff holding extensive government certifications; therefore, our prices are fixed. We do not offer individual discounts or rate negotiations, allowing us to focus all our resources on providing the highest safety standards and premium quality on every experience.

Safety and Responsibility

  • Health & Medical Requirements: Our activities require an adequate level of physical fitness. It is your responsibility to inform us of any pre-existing medical conditions (such as heart or respiratory issues, or recent surgeries). Depending on your medical history, written physician clearance may be required before any diving activity. We reserve the right to restrict your participation if we consider there is a risk to your safety.

  • Alcohol and Drug Policy: For safety reasons, boarding and participation in any activity will be strictly prohibited for individuals showing signs of being under the influence of alcohol or drugs. In such cases, the reservation will be cancelled immediately without the right to a refund.

  • Personal Insurance: It is the responsibility of each participant to have their own medical insurance or specialized scuba diving insurance if applicable (e.g., DAN) that covers adventure and water sports activities.

​

  • Certifications and Compliance: All our tours and experiences are led by experienced PADI Instructors. Our team holds the federal NOM-09 certification, which is Mexico's highest safety and rescue standard for adventure tourism, and official Mexican Seaman’s Books (Libreta de Mar). Additionally, our guides possess all government-mandated training and permits required for each specific activity such as swimming with Orcas or Whale Sharks to ensure strict adherence to safety and environmental protection protocols.

  • Equipment Care: We take pride in providing high-quality gear for your adventure. We kindly ask guests to help us look after it; please note that any loss or significant damage due to misuse may incur a replacement fee based on its current market value.

  • Environmental Protection: We follow strict "No Touch" policies to protect our ecosystem, which are thoroughly explained during our pre-activity safety briefings. Any guest intentionally disturbing marine life, feeding animals, damaging coral reefs, or harming the environment in any way may have their activity terminated immediately without the right to a refund.

  • Media and Image Use: By booking, the client agrees to the use of audiovisual material captured during the tour for promotional purposes (as stipulated in our liability waiver). If you prefer to maintain your privacy, please notify our staff before boarding.

Guest Policy

Guests Policy

​All individuals onboard are considered guests, whether participating in the activity (diving or snorkeling) or accompanying as observers.

 

For guests accompanying in local Diving & Snorkeling, a reduced fee of 1000 MXN (Marine Park) or 1,200 MXN (Corridor) applies to non-participants. For Cabo Ocean Safaris, Whale Watching, and Day Trips, the full tour rate applies to all passengers.

 

Pregnancy & Minimum Age: For safety reasons regarding slips and falls, we cannot accommodate pregnant women or infants (children under 6 years old) on any boat activities. By booking, you confirm all guests meet these requirements.

 

All guests must follow crew instructions and safety guidelines at all times. The captain and guides reserve the right to limit or refuse participation in any activity if conditions or safety requirements are not met. Availability of space onboard is limited, and all guests must be confirmed in advance.

Cancellations and Refunds

Cancellations and Refunds

Breathe Out Baja reserves the right to cancel any booked activity if circumstances require it. In such cases, we will help you reschedule for an alternative date or issue a full refund of the amount paid. If a cancellation is necessary, our team will contact you by email and WhatsApp as soon as possible.

Common reasons for cancellation include:​​

  • Adverse weather conditions that pose a risk or make the tour impossible (e.g., strong winds, unsafe navigation, or port closure). We monitor forecasts before confirming your booking to ensure the best possible conditions; however, we operate in a natural environment in Cabo San Lucas and Baja California Sur, so unexpected changes can occur. The Harbor Master may restrict or close the port if navigation is deemed unsafe, and we must comply with those orders.​ Please note that cancellations due to weather are at the sole discretion of the Harbor Master and our Captains to ensure your safety. We prioritize your well-being above all else.

​

  • Minimum number of participants not met. Most of our group tours require a minimum number of guests to operate. Private experiences, including private tours and private courses, are exempt from this requirement. If the minimum for a group tour is not met, we will notify you by the day before departure to offer a full refund or an alternative date. If you prefer to proceed with the original schedule, you may choose to cover the cost of the remaining spots to guarantee the departure.

Day Trips (e.g., Cabo Pulmo, La Paz, Puerto Chale, La Ventana):

  • More than 72 hours before departure: We refund your payment minus a 10% processing fee to cover non-refundable transaction costs and administrative handling.

  • Between 72 and 48 hours: A 50% cancellation fee applies (50% refund of the total price).

  • 48 hours or less, or no-show: 100% of the tour price is charged (No refund).

PRIVACY & COOKIES

Your data is used only for bookings and to improve your experience via cookies, per our Privacy Policy.

BOOKING AGREEMENT

By booking, you agree to all the policies listed above and our standard liability waiver.
