This Privacy Policy outlines how we collect, use, and protect your data when you visit our website or use our services, in accordance with Mexico's Federal Law on the Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de los Particulares).

We collect information that you voluntarily provide to us when you fill out our contact form, book with us, sign our waiver or communicate with us. This may include:

  • Identity Data: Name, surname, and date of birth. 

  • Contact Data: Email address and phone number (WhatsApp). 

  • Emergency Contact: Name and contact number of an emergency contact. 

  • Policy Data: Insurance company and policy number. 

  • Health Data (sensitive personal data): Any medical condition you tell us about in our liability waiver and, for PADI programs such as Discover Scuba Diving, the PADI medical form.

  • Photos and Videos: Images captured during our tours.

  • Technical Data: IP address, browser type, and usage data collected through cookies.

Sensitive Personal Data

Health information is considered sensitive personal data. We only ask for it to assess whether you can safely take part in an activity, and we ask for your express written consent, through your signature on our liability waiver or on the PADI medical form, before processing it. We do not use it for any other purpose.

How We Use Your Information

We use your data for the following purposes, which are necessary to provide our services:

  • Responding to your inquiries and providing quotes for our tours.

  • Managing your bookings and sending essential trip information.

  • Ensuring your safety during the activity, including contacting your emergency contact if needed.

  • Complying with local legal and tax requirements, such as invoicing (facturación) in Mexico.

We may also use your data for the following purposes, which are optional and which you can decline at any time:

  • Using photos and videos captured during our tours for promotional purposes.

  • Sending you news or offers about our tours.

  • Improving our website's functionality and user experience.

How to Limit the Use of Your Data

If you do not want your data to be used for the optional purposes above, for example if you would prefer not to appear in our photos or videos, just let us know before the tour or write to us at info@breatheoutbaja.com. Declining these uses will not affect your booking or the service you receive.

You have the right to access your personal data, to correct it if it is inaccurate or incomplete, to request its cancellation, and to object to its use (known in Mexico as ARCO rights). You can also withdraw your consent at any time.

  • A copy of an official ID, or proof of representation if you act on behalf of someone else.

We will reply within 20 days of receiving your request and, if it is approved, we will carry it out within the following 15 days.
